CHAPTER 8
MISCELLANEOUS PROVISIONS

Provision of Temporary Shelter:

Article 53:

Heads of detention centers and prisons by the distinction of Attorney General’s Office after the permission of ministry of justice and written demand by the individual can provide temporary shelter and protection in detention centers and prisons to those who have been seriously threatened and their safety are at serious risk.

 

Article 54:

(1) Journalists, photographers and filmmakers after getting prior permission of the superintendents of prisons and the prisoners, shall be allowed to inter the prisons and detention centers and provide reports on the life conditions of the prisoners.

(2) Superintendents of prisons with except in emergency situation shall grant permission to the journalists.

 

Article 55:

(1) Superintendents of prisons in accordance with the paragraph 2 of article 27 of this law after prescribing by doctor shall hospitalize the pregnant women prisoner to the hospital before or upon the delivery.

(2) The patient after recovery shall be taken back to the prison only after prescription of the relevant doctor.

(3) The hospitalization period shall be calculated in the period she has spent in the prison.

 

Article 56:

The Government shall provide facilities to the children up to the age of three years that are lining with their parents in the prisons.

The children above the age of three shall be transferred to the nursery established by the Government adjacent to the prison.

The parents shall be allowed to visit their children on daily bases.

Children above the age of 7 shall be transferred to the nurseries established by the Government in the cities.

Children can stay with their father in the prison when their father is the only caretaker of his children.

Date of Enforcement of this Law:

Article 57:

This law shall be enforced from the date of its publishing in the Official Gazette. With its enforcement, the Law on Applying the Imprisonment Penalty in Prisons and the Regulation on Procedures for Holding the Accused in Detention Centers published in the Official Gazette No. 793 dated 20 August 2000 shall be considered null and void.
